We frequently advise general contractors, construction managers, engineers, architects, subcontractors and material suppliers in contract drafting and disputes, Change Order claims, Requests for Information (“RFI”), Construction Change Directives (“CCD”), disruption, loss of productivity, and home office overhead (Eichealy) damages. We have vast knowledge of insurance, fidelity, surety, indemnification and contract issues. We routinely negotiate construction contracts involving multi-million dollar projects and are intimately familiar with how plans, contracts, and specifications relate to each other. We work with Construction Managers and Risk Managers so that projects are completed smoothly and profitably. We have negotiated Joint Venture Agreements under section 8(a) of the Business Development Program (SBA).

Our lawyers have a proven track record of handling issues relating to delay, acceleration, disruption, inefficiency, cumulative impacts and claims for errors and omissions by design professionals who fail to properly coordinate construction drawings. We have represented contractors in disputes with the Federal Government, including the US Army Corps of Engineers (“USACE”) involving a Request for Equitable Adjustment (REA) and other issues under The Contract Disputes Act.

Our experience includes all aspects of the bidding process, how to protest a bid, issues relating to labor and prevailing wage claims, and the impact projects can have on a contractor’s ability to obtain bonds. Our litigation experience has involved construction disputes arising out of the development of schools, libraries, firehouses, parks, recreational facilities, condominium projects, residential developments, among other projects. Recent settlements have included an $1,200,000 payment by a New Jersey municipality for the wrongful termination of a contractor on a public project and a substantial settlement with the United States Army Corp. Of Engineers.
